105(I) Lease - 638 Contracting
What is a 105(I) Lease?
Our tribes and tribal organizations have had difficulties obtaining suitable facilities and equipment to operate programs contracted under the Indian Self-Determination Act (PL 93-638).
In 1988, significant improvements were made to federal statutes and regulations under the Indian Self-Determination Act to assist tribes in operating their contracted programs. One of these improvements included provisions allowing tribes and tribal organizations to lease tribal facilities to the Secretary for the operation of programs contracted under PL 93-638.
105(l) leases are facility cost agreements that compensate the Tribes for facility operational expenses associated with using the facility to administer (ISDEAA) contracted/compacted services. We provide guidance to tribes and tribal organizations on utilizing Section 105(l) of the Act to lease tribal facilities from the Secretary.

with information and help in any way they possibly could. I felt extremely comfortable with them taking
lead on certain things pertaining to the process as I knew we were in good hands. Honestly, I just kind
of say back as Ben lead the way to make sure everything was taken care. He was available for any
questions I had about the process and made sure he kept me in the loop as things were happening. It
felt we had just started the process and all the sudden all paperwork was submitted and follow-up was
completed and we had received our letter stating what we were being awarded. Because of their
expertise and efficiency in getting our funds, it opened the door for them to start the process to assist
the other Tribal departments within our Tribal organization. They wasted no time and hit the ground
running in getting everything organized to start the process for those departments and programs, by
setting up meetings and making contact with the necessary people.
I cannot say enough good things about the amazing work they do but I can say with complete
